More questions regarding registered sex offender hired for event at Silverbook School in West Bend, WI

November 28, 2024 – West Bend, Wi – It may take weeks before answers are provided regarding how a registered sex offender was hired to provide entertainment for a student event at Silverbook School in West Bend, Wi.

The event was a Valentines Dance held February 23, 2024. Nicholas Mistrioty is facing felony charges. Those details are posted below.

The West Bend School District issued a statement and a follow-up response to more questions such as:

Questions: what is the official vetting procedure supposed to be for activities like this Valentines dance and where was the failure?

What is the name of the adult supervisor for the Student Council at Silverbrook?

Who ultimately needs to be held responsible for the miss?

What gaps (if any) have been identified and need to be closed and how?

How many times has this happened before?

What other DJ services were vetted for this event?

The timeline of calls /correspondence made today to police.

One interesting note regarding the false name used by Mistrioty to work as a DJ came from public insight.

November 26, 2024West Bend, Wi – A 45-year-old West Bend, WI, man who is a registered sex offender is facing multiple felony charges including failing to notify school of offender status. One of the schools listed on the criminal complaint is Silverbrook School in the West Bend School District.

According to the criminal complaint ‘Nick Maseraty’ (whose actual name is Nicholas G Mistrioty) was a DJ at a February 23, 2024, Valentine’s dance at Silverbrook School.

Calls were placed to Superintendent Jen Wimmer at 11:31 a.m., 11:32 a.m. and an email after that. A response was she is out of the office, November 26, 2024.

The District has posted information on its website, however there are no details on how it vets the people coming into the district or when parents were notified about the incident following the February 2024 venue.

West Bend Police Department Investigation

The District was recently informed by the West Bend Police Department of an investigation involving a registered sex offender who used a false name to work as a DJ. This individual was part of a DJ team hired for the February 23, 2024, Student Council-sponsored dance after school at Silverbrook. A letter was sent to all current sixth and seventh grade families who might have had children at the dance last year.

The District collaborated with the West Bend Police Department in their investigation, which resulted in the individual immediately being taken into custody and facing criminal charges for using a false name, working where children were present, failing to notify school officials of his sex offender status, and being present on school grounds. There was no known incident at the dance; however, any one with additional information is encouraged to contact the West Bend Police Department at (262) 335-5000.

All school dances are fully chaperoned by school staff to maintain a supervised environment. The safety and well-being of our students are of the utmost importance to us. We are deeply grateful to the West Bend Police Department for their swift and thorough action in ensuring the safety of our students and community. The company that employed this individual will no longer be used in our district.

Nicholas G Mistrioty is facing five felony charges including failing to provide information and two counts of a child sex offender working with children.

Mistrioty is accused of using multiple different names. A list from the court files is below.

Mistrioty is due back in Washington County Circuit Court on January 8, 2025. He will appear before Judge Michael Kenitz.

A copy of the WBSD letter to parents is below. Still awaiting clarification from the district on when this letter was sent to parents. Initial calls from WashingtonCountyInsider.com to the district about this issue were place starting at 11:31 a.m. on Tuesday, November 26, 2024. As of 3:03 p.m. we are still awaiting response from the district.
